Research at the intersection of law, technology and policy.

In 2022 Simone Herbert-Lowe presented a peer-reviewed paper at the IEEE

International Symposium on Technology and Society — one of the world's leading forums for the intersection of technology and law. The paper, "Payment redirection fraud — who does (and who should) bear the loss in fraudulent banking transactions, and is Australia's electronic banking system fit for purpose?", was subsequently published in IEEE Xplore, the Institute of Electrical and Electronics Engineers' global research database.

The paper argued that Australian banks should implement name-matching verification for electronic funds transfers — the same mechanism now known as Confirmation of Payee — and that the absence of this protection represented an unreasonable transfer of financial risk from banks to individual customers and businesses.

Following publication, Simone was invited to give evidence to the Parliamentary Joint Committee on Law Enforcement into Cybercrime — a recognition of the depth of her expertise and the relevance of her research to Australia's policy response to payment fraud.

In the period that followed, a key reform the paper had argued for was adopted — the banking sector's Scam-Safe Accord introducing Confirmation of Payee.


INDUSTRY ENGAGEMENT

Contributing to the national conversation.

Law & Cyber has engaged at the highest levels of policy and practice in

Australia's cyber and privacy landscape. Our contributions include a formal submission to the Australian Government's 2023–2030 Australian Cyber Security Strategy and, following her IEEE peer-reviewed research on payment redirection fraud, Simone Herbert-Lowe was invited to give evidence to the Parliamentary Joint Committee on Law Enforcement into Cybercrime — one of the most significant policy processes examining Australia's response to cybercrime. We have delivered keynote presentations for Thomson Reuters and Relativity, and our education programs have been distributed by leading professional associations and insurers to tens of thousands of members and policyholders across Australia.

We believe that building a cyber-resilient Australia requires more than good legal advice delivered in isolation. It requires practitioners who are willing to engage with policymakers, regulators and professional communities — contributing expertise where it can shape outcomes at a national level.
