THE PROBLEM

The Federal Court's GPN-AI (April 2026) and the NSW Supreme Court's SC Gen 23 (February 2025) set out what is now required of everyone involved in proceedings who uses AI — lawyers, litigants, witnesses and third parties.

These are not aspirational guidelines. They sit within existing professional obligations. Australian practitioners have already been referred to their regulators after filing AI-generated case citations that did not exist.

The question courts are asking is not whether AI was used. It is whether that use can be explained and justified if it is ever scrutinised.

This session is designed for law firms of all sizes — from sole practitioners to national practices. It is relevant to all lawyers who use or are considering using generative AI tools in their practice, and to firm leaders and managing partners who need to understand their firm's obligations and governance responsibilities in this area.
